The presiding Chief Magistrate, Mr Mike Osayi, said that Aigbedion committed an offence against morality saying “If the accused is remanded in prison custody for long, he is going to mix up with same sex and likely commit the same offencer.”
Osayi, however, said that bail would be considered in the next adjournment date.
Earlier, the police prosecutor, ASP Sylvester Omor, told the court that the accused committed the offence at Erie Street, Off Sakponba Road, Benin, Dec. 2013.
“The accused unlawfully had carnal knowledge of Mr Okereke through the anus against the order of nature,” Omor said.
The prosecutor said that the offence contravened section 214 (1) of the Criminal Code.
According to the Criminal Code, if convicted, he is liable to 14 years imprisonment. The accused, however,pleaded not guilty to a one-count charge of unnatural offences.
